Attorney Paulo Faria has reported Supreme Federal Court (STF) Minister Alexandre de Moraes to the United States Embassy in Brazil for ordering the arrest of an American citizen.
In the petition, Faria requests the application of the Magnitsky Act, a law that allows sanctions against individuals who violate the human rights of US citizens. Faria represents the Brazilian and American citizen Flávia Magalhães Soares, who is the target of preventive detention in Brazil due to a post on the X social network and alleged irregular use of documents.

The complaint, formalized on March 4, 2025, argues that Flávia had her freedom violated without prior notification. In 2022, she published content on the Twitter/X platform. In 2023, her account was blocked without warning, and she only learned about it through third parties. In the same year, between December 5 and 11, she entered and left Brazil regularly with an American passport, registered by the Federal Police (PF).

Attorney points to lack of legal basis in Flávia's arrest request

Even without disobeying judicial decisions, Flávia had preventive detention ordered on February 8, 2024, and her name was included in the National Bank of Arrest Warrants of the National Justice Council (CNJ) on February 14. Paulo Faria explains that Flávia's arrest request has no basis. "The accusation of trying to irregularly enter the country is unfounded, as her passport was stamped according to legal immigration procedures," he explains.

The attorney argues that the arrest violates Brazilian and international legal principles. "The legislation requires personal notification before any punishment, which did not occur," he said. "Less severe measures, such as coercive fines, should have been applied before imprisonment. The case constitutes abuse of authority and violation of constitutional guarantees."

STF decision violates amendments to the US Constitution

Furthermore, the decision violates the United States Constitution. The First Amendment protects freedom of expression, a right exercised by Flávia when publishing her content in the United States. The 14th Amendment protects American citizens against illegal actions by foreign governments. Censorship and arbitrary arrest directly violate these legal protections.

The attorney requests the revocation of preventive detention, recognition of the illegalities committed, and investigation of the case by the United States Embassy. He also requests the application of the Magnitsky Act against Alexandre de Moraes and other agents involved, as well as the involvement of international human rights organizations.
