Brazil's Ministry of Foreign Affairs has issued a statement regarding the latest developments involving the United States government and the Federal Supreme Court (STF). In a note released this Wednesday (26), the ministry claims that the US State Department "distorts the meaning" of STF decisions. In a publication by the US State Department posted today and reshared by the United States Embassy in Brasília, the agency criticized judicial decisions by the STF involving American companies.
"The Brazilian government firmly rejects any attempt to politicize judicial decisions and emphasizes the importance of respecting the republican principle of separation of powers, enshrined in the Brazilian Federal Constitution of 1988. The State Department's statement distorts the meaning of the Federal Supreme Court's decisions, which are intended to ensure the application of relevant Brazilian legislation within the national territory, including the requirement for all companies operating in Brazil to establish legal representatives," the document states.
"Respect for sovereignty is a two-way street with all US partners, including Brazil. Blocking access to information and imposing fines on US-based companies for refusing to censor individuals living there is incompatible with democratic values, including freedom of expression," says the American government's position.
Although not specifically naming the Brazilian Supreme Court, the US statement refers to Minister Alexandre de Moraes' decision last week to suspend the Rumble video platform in Brazil. According to the magistrate, this occurred due to "conscious and voluntary non-compliance with judicial orders" by the company, as well as an "attempt to not submit to Brazilian legal order and Judiciary."
On Tuesday (25), the United States Federal District Court in Florida stated that both Rumble and Trump Media, a company owned by President Donald Trump, are not obligated to comply with orders issued by Minister Alexandre de Moraes. Itamaraty also said it "received with surprise" the latest determinations.

The Brazilian government receives, with surprise, today's statement by the US State Department regarding a lawsuit filed by private companies from that country to exempt themselves from complying with decisions of the Brazilian Supreme Court.
The Brazilian government firmly rejects any attempt to politicize judicial decisions and emphasizes the importance of respecting the republican principle of separation of powers, enshrined in the Brazilian Federal Constitution of 1988.
The State Department's statement distorts the meaning of the Federal Supreme Court's decisions, which are intended to ensure the application of relevant Brazilian legislation within the national territory, including the requirement for all companies operating in Brazil to establish legal representatives. Freedom of expression, a fundamental right enshrined in the Brazilian legal system, must be exercised in Brazil in accordance with other current legal provisions, especially those of a criminal nature.
The Brazilian State and its republican institutions were the target of an anti-democratic orchestration based on mass disinformation, disseminated on social media. The facts involving the attempted coup against popular sovereignty, after the 2022 presidential elections, are the subject of ongoing action in the Brazilian Judiciary.
